Governor signs seven bills, sends one back to the Senate

On the 74th day of a 90 day legislative session, Governor Kathleen Sebelius has signed seven bills, bringing the total number of bills signed for this session to 26 with one having been vetoed.

Message on SB 410

“Senate Bill 410 was inadvertently engrossed without a necessary amendment, prohibiting the Senate from taking appropriate action to approve the bill. Therefore, I am sending it back to the Senate.”

Designating K-53 as Patriot Guard Highway

HB 2708 designates K-53 as Patriot Guard Highway. This bill goes into effect after its publication in the statute book.

Designates portion of US 400 as the Atomic Veteran’s Memorial Highway

HB 2659 Designates portion of US 400 as the Atomic Veteran’s Memorial Highway from the east junction of US highway 400 with US highway 77 to US highway 54 east to the eastern boundary of Butler County. This bill goes into effect after its publication in the statute book.

Responding to notification from the Kansas Electric Transmission Authority

SB 614 clarifies that the 90-day time period for private entities to respond to a notification from the Kansas Electric Transmission Authority (KETA) begins when notice is published in the Kansas Register. This bill goes into effect after its publication in the statute book.

Provides definition for ‘small business’

SB 579 requires state agencies to consider the impact of proposed rules and regulations on small businesses. The bill would define small businesses as any person, firm, corporation, partnership, or association with 50 or fewer employees, the majority of whom are employed in the State of Kansas. This bill goes into effect after its publication in the statute book.

Distribution of moneys from E-911 fees

SB 526 deals with disbursement of E-911 fees that cannot be forwarded to local Public Service Answering Points. This bill allows this money to be spent to help counties improve their enhanced 911 technologies. Money will first be spent aiding counties that are not in full compliance with E-911 benchmarks. Once all counties are in compliance, money can be spent on any county. This bill goes into effect after its publication in the statute book.

Amending the code of civil procedure for electronically stored information.

SB 434 amends the Code of Civil Procedure to include the disclosure and discovery of electronically stored information for use in district court proceedings. These amendments will conform the Kansas Code of Civil Procedure with the amendments made to the Federal Rules of Civil Procedure in 2006. This bill goes into effect after its publication in the statute book.

Enacts the Uniform Prudent Management of Institutional Funds Act

SB 433 enacts the Uniform Prudent Management of Institutional Funds Act which provides statutory guidelines for management, investment, and expenditure of endowment funds held by charitable institutions. This Act replaces the Uniform Management of Institution Act that was written 35 years ago and in now out of date. This bill goes into effect after its publication in the statute book.
