EXECUTIVE ORDER 06-08

WHEREAS, Article 1, § 3 of the Constitution of the State of Kansas vests the supreme executive power of the state in the Governor; and

WHEREAS, Article 1, § 4 of the Constitution of the State of Kansas vests in the Governor the power to require information from the officers of the executive department upon any subject related to their duties; and

WHEREAS, Kansas state government is a complex combination of organizations and functions providing a wide variety of services to citizens and other customers; and

WHEREAS, there is a recognized need to increase quality and lower costs of services provided to Kansas citizens through informed application of geographic information systems technology; and

WHEREAS, improved coordination of the state’s geographic information systems resources and development of an infrastructure that promotes efficient service delivery and data sharing among state organizations, federal and local government entities is an essential element in improving the quality of services provided to the people of Kansas.

NOW, THEREFORE, pursuant to the authority vested in me as Governor of the State of Kansas, I hereby reformulate the composition of the Kansas Geographic Information Systems Policy Board (“Board”) with the following purposes and charges:

  1. The Board shall establish public and private partnerships throughout Kansas to maximize value, minimize cost, and avoid redundant activities in the development and implementation of geographic information systems.
  2. The Board shall foster efficient and secure methods for data sharing at all levels of government.
  3. The Board shall coordinate, review, and provide recommendations on geographic information systems programs and investments and provide assistance with dispute resolution among geographic information systems partners.
  4. The Board shall continue to establish Kansas’ leadership role in the national effort to improve capabilities for sharing geographic information and ideas with other states.
  5. The Board shall promote the use of geographic information systems technologies as tools to breakthrough structural and administrative boundaries to collaborate on shared problems and enhance information analysis and decision-making processes within all levels of government.
  6. The Board shall be a standing advisory committee to the Information Technology Executive Council, and shall provide a copy of its annual report to the Council, as well as to the Governor and Legislature.
  7. The Board shall consist of 37 members as follows:

    1. Chief Information Technology Officer representing the executive branch;
    2. Chief Information Technology Officer representing the legislative branch;
    3. Chief Information Technology Officer representing the judicial branch;
    4. The Adjutant General of Kansas;
    5. The Secretary of the Department of Agriculture, or designee;
    6. The Chairperson of the Kansas Corporation Commission, or designee;
    7. The Director of the Kansas Water Office, or designee;
    8. The Commissioner of the Department of Education, or designee;
    9. The Secretary of the Department of Health and Environment, or designee;
    10. The Secretary of the Department of Revenue, or designee;
    11. The Secretary of the Department of Transportation, or designee;
    12. The Executive Director of the State Conservation Commission, or designee;
    13. The Secretary of the Department of Wildlife and Parks, or designee;
    14. The Secretary of Social and Rehabilitation Services, or designee;
    15. The Director of the Kansas State Historical Society, or designee;
    16. The Director of the Kansas Geological Survey, or designee;
    17. The Director of the Kansas Biological Survey, or designee;
    18. The District Chief of the United States Geological Survey; or designee; and
    19. The District Chief of the Natural Resource and Conservation Service, or designee.
    20. The Governor shall appoint the following 18 members whose terms of four years shall be subsequent to the terms of like members established by Executive Order 2000-07, with the exception that the terms of members who are serving on the board on the effective date of this Executive Order shall expire on September 30 of the year in which such member’s term would have expired under Executive Order 2000-07.  Two of the additional representatives of local government shall serve an initial term expiring September 30, 2008, with the remaining two additional representatives of local government serving an initial term expiring September 30, 2009, and all four thereafter shall serve a term of four years.  The additional representative from a Regents institution shall serve an initial term expiring September 30, 2008, and shall thereafter serve a term of four years.  Of the two additional representatives of a relevant statewide business or professional organization, one representative shall serve an initial term expiring September 30, 2008, with the remaining additional representative of a relevant statewide business or professional organization serving an initial term expiring September 30, 2009, and both shall thereafter serve a term of four years.  Thereafter, members shall be appointed for terms of four years and until their successors are appointed and qualified.

      1.  9 representatives of local government; including cities, counties, or local government consortia of cities, counties, non-profit and private sector enterprises.  Such members may include, but not be limited to, representatives from city and county commissions or planning councils, tribal government, law enforcement, county clerks, county appraisers and emergency planning divisions;
      2. 3 representatives of Regents institutions;
      3. 3 executives representing the private sector.  Members from the private sector may include, but not be limited to, representatives from the trucking industry, utilities, telecommunications, publishers, agriculture, oil and gas industry, chambers of commerce, aircraft and auto industry, and the banking community;
      4. 3 representatives of a relevant statewide business or professional organizations, such as statewide associations of groundwater management districts, emergency planning, law enforcement, licensed surveyors, and other relevant technical professions or agriculture-related business.
  8. All other members shall serve terms consistent with their terms of office, employment or appointment.
  9. The Governor may remove a member from the Board should lack of attendance or lack of participation be demonstrated.
  10. The Governor shall select a Chairperson and Vice-Chairperson from among the members who shall serve at the discretion of the Governor.  The Board may elect other officers among its members and may establish any committees deemed necessary to discharge its duties.
  11. Members of the Board shall not receive compensation, subsistence allowance, mileage or associated expenses.  Officers or employees of state agencies who are appointed to the Board shall be authorized to participate on the Board as part of their duties and may claim subsistence allowance, mileage or associated expenses as permitted by law.
  12. For administrative purposes, the Board shall be housed in the Division of Information Systems and Communications.  The Board shall receive staff support from the State Geographic Information Systems Director.
  13. The Board shall work jointly with officials from other state agencies, organizations and county, municipal and tribal governments, as well as with businesses and organizations in the private sector who are concerned with the efficient management of the State’s geographic information systems resources.

This order shall continue in full force and in effect until the date of any subsequent Executive Order with respect to the subject hereof is promulgated.

Executive Order 2000-07 shall be rescinded on the effective date of this Executive Order.

This document shall be filed with the Secretary of State as Executive Order No. 06-08 and shall become effective immediately.
